Who this page is for
For rights holders and their representatives who believe that their work has been posted on BardWay without permission: a song in a streamer’s catalog, lyrics or chords, an image in a page design, material in a public profile.
This material is posted by users. For it we act as an information intermediary and handle notices under Russian law, which governs the Service: Article 1253.1 of the Civil Code of the Russian Federation and Article 15.7 of Federal Law No. 149-FZ “On Information, Information Technologies and Information Protection”. We accept notices from rights holders in any country, including notices prepared under the law of another country; if such a notice lacks information listed below, we will ask for it.
How to send a notice
Send a complete notice — with the sender’s details, a copy of the document confirming a representative’s authority and consent to the processing of personal data — by e-mail to info@bardway.com with the subject “Rights holder notice”.
The form at bardway.com/report, section “Copyright”, is suitable for a quick report of an infringement: it has no fields for identity document details and does not take attachments. If a report sent through the form lacks information from the section below, we will ask you to send a complete notice by e-mail.
If you prefer a paper letter, write to this e-mail and we will give you a postal address.
What the notice must contain
Under the law that governs the Service, a notice must contain:
- details of the sender: for an individual — full name, passport or other identity document details (number, issuing authority and date of issue) and contacts: e-mail (phone optional); for an organisation — its name, registered address and contacts;
- if you are a representative — whom you represent and a document confirming your authority;
- which work is used without permission: title, author, a link to the original or a description;
- the address of the BardWay page where the material is posted, and what exactly on it infringes the rights: a song, lyrics, chords, an image;
- a statement that the rights to the work belong to you or to the rights holder you represent;
- a statement that the rights holder has not given permission for this posting;
- consent to the processing of your personal data.
The law does not require documents proving the rights, but they make the review faster.
Time limits
We review a complete notice within 24 hours of receiving it and remove the material or restrict access to it.
If information in the notice is missing or inaccurate, we will ask you once, within 24 hours, to clarify it. The 24 hours then run from when we receive the clarified information.
If we have evidence that the material was posted lawfully (for example, the streamer is the author of the song or has a licence), we may keep it and will send you a notice with this evidence.
What happens after removal
We tell the streamer which material was removed and why. We may tell the streamer the rights holder’s name and the substance of the claim; we do not pass your identity document details or contacts to the streamer.
Repeated infringements lead to measures up to deleting the streamer’s account.
Counter-notice from the streamer
If the streamer disagrees with the removal, they may send a counter-notice to info@bardway.com with evidence of lawful use: a licence, an agreement with the rights holder, proof of authorship or of the work being in the public domain.
We will forward the counter-notice and the evidence to the sender of the notice. If the evidence is convincing, we may restore the material and will tell the sender. A dispute on the merits between the rights holder and the streamer is for a court to decide.
Inaccurate notices
Send a notice only if you are sure of your rights. A knowingly false notice infringes the streamer’s rights and may make the sender liable under the law.
Streams, recordings and clips
BardWay does not broadcast streams and does not store their recordings or clips. If your claim concerns what was heard on a stream, a stream recording or a clip, contact the platform where they are published as well.
Your personal data
We process the information in a notice to review it and reply, and keep it for up to 1 year, as described in the Privacy Policy.
