What the Service does
BardWay is a song request panel for musician streamers who perform music live. The Service helps a streamer keep their own repertoire, take viewers’ requests and run a queue of songs the streamer will perform themselves. BardWay does not store, stream or distribute sound recordings.
This version is for users outside Russia, Armenia, Azerbaijan, Belarus, Kazakhstan, Kyrgyzstan, Moldova, Tajikistan, Turkmenistan and Uzbekistan. It supplements the Terms of Service.
The streamer’s responsibility
The streamer decides what to perform on air and arranges the performance. By adding a song to the catalog, the streamer confirms that they have the right to perform it publicly on stream. The streamer is responsible for the legality of the repertoire and of what is heard on air.
BardWay only provides the technical means to keep a catalog and take requests. We are not the rights holder or a licensee of the works in streamers’ catalogs.
What may be added to the catalog
- the streamer’s own works;
- covers, that is performances of someone else’s song without changes, if the streamer has the right to perform it on air, for example under a licence from the collective management organisation of their country;
- arrangements and adaptations of other people’s songs — only with the permission of the author or the rights holder: a performance licence does not cover them;
- works in the public domain;
- works the streamer has received permission to perform directly from the rights holder.
Check the terms of your licence: a licence to perform on air may not cover stream recordings and clips.
Lyrics and chords
Lyrics and chords can be added to a song card. Viewers see them on the streamer’s catalog page. So add lyrics and chords only if you have the right to publish them: it is your own song, a work in the public domain, or you have the rights holder’s permission.
Do not post the lyrics, chords or sheet music of other people’s songs without such a right. On a rights holder’s notice we will remove them or restrict access to them.
What is prohibited
- playing studio or other recordings by others on air and passing them off as a live performance;
- using other people’s backing tracks without the rights holder’s licence;
- publishing sheet music, chords, lyrics and audio fragments you do not hold the rights to;
- using requests to push a streamer into performing a song they have no rights to.
Platform rules
The platforms where the stream takes place set their own rules for using music, and these apply to the stream alongside this policy. For example, the Twitch rules: legal.twitch.com/en/legal/music. We do not monitor what is streamed — the platforms do.
BardWay’s role
Catalogs, lyrics, chords and page designs are posted by streamers. For this material we act as an information intermediary (Article 1253.1 of the Civil Code of the Russian Federation): we do not select or modify it and do not check it in advance.
When we receive a rights holder’s notice, we act under the procedure of Russian law (Article 15.7 of Federal Law No. 149-FZ “On Information, Information Technologies and Information Protection”): we review a complete notice within 24 hours and remove the material or restrict access to it, unless we have evidence that it was posted lawfully — in that case we send this evidence to the sender. How to send a notice is described on the page “For rights holders”.
Measures for violations
If a violation is found — by us, on a rights holder’s notice, on a report from a platform or another interested party — we may: (1) remove the disputed song, lyrics or chords from the streamer’s catalog; (2) restrict adding new songs to the catalog; (3) temporarily suspend the streamer’s access to the Service while we look into the matter; (4) permanently end access and delete the project for a confirmed or repeated violation. Measures are proportionate to the nature and seriousness of the violation.
Changes to this policy
A new version of this policy is published on this page with its date. We tell you about significant changes in the Service and ask you to accept the new version.
