Terms of Service

Acceptance of Terms

By using the BardWay service (the "Service") you agree to these Terms of Service, the Privacy Policy and the Music and Copyright Policy. Signing up for the Service or continuing to use it means you have accepted these Terms. If you do not agree with them, do not use the Service. We may change these Terms. We announce material changes in the Service or by email and ask you to confirm that you accept the new version. Continuing to use the Service after the changes take effect also means you accept it.

Permitted and Prohibited Use

The Service is intended for managing song catalogs, viewer requests and related stream automation. You may not use the Service to violate the law, to host illegal or abusive content, to infringe third-party intellectual property, or to collect or share other users' personal data without consent. You also may not abuse the features of the Service: inflate requests, spam through the bot, bypass plan limits or impersonate someone else. Rules for uploaded material and page design are set out in the sections "User Content and Page Design", "What You May Not Post" and "Advertising in Page Design".

Account and Data

You agree to provide accurate registration information and are responsible for keeping your credentials safe. The BardWay team may access content stored in the Service for operational and security purposes only.

User Content and Page Design

User content is anything you upload or enter in the Service: design images and GIFs (cover, side banners, avatar), the page title, song names and descriptions, and bot command and reply texts. By uploading content you confirm that you created it yourself or have the right to use it, and that publishing it does not break the law or anyone else's rights: copyright, trademarks, or a person's right to their own image. You are responsible for your content. You keep the rights to your content. You give BardWay a free, non-exclusive permission to store it, process it (compress, resize, convert) and show it on your public pages and widgets. This permission exists only to run the Service and lasts while the content is published and while a report about it is being reviewed. Page design is visible to every visitor, including minors. It must be suitable for all audiences: adult (18+) material is not allowed. Published images are public. Visitors and search engines can save them, and we cannot control that.

What You May Not Post

User content, including page design and the page title, must not contain: β€” material that is illegal in your country or under the law that applies to the Service; β€” pornography, nudity or sexualized images, including drawn, blurred or partly covered ones; β€” any material that sexualizes minors; β€” realistic or shocking violence, injuries, gore; β€” methods of suicide or self-harm, or encouragement of them; β€” drugs and other psychoactive substances, their sale or use; β€” symbols of or calls to support extremist or terrorist organizations, hate speech, discrimination on any grounds; β€” insults, harassment, threats, defamation, or other people's personal data; β€” impersonation of another person, streamer or company, including BardWay or streaming platform staff, and imitation of Service buttons or interface; β€” links, QR codes or text leading to phishing, malicious or fraudulent resources; β€” other people's art, logos or photos of people without permission from the rights holder or the person shown. This list is not exhaustive. The BardWay team decides whether material breaks the rules. Similar material on another streamer's page does not make yours acceptable β€” please report it to us instead.

Advertising in Page Design

Your page design is a showcase for your channel, not an ad space. You may show your nickname, logo, mascot and your own art, as well as the names and logos of your social accounts and your own merch. Links and QR codes are not allowed in page design, even if they lead to your own resources. Third-party advertising is not allowed in any form: sponsors and partners, banners, logos and slogans of other brands, promo codes, referral and affiliate links. The name or logo of another service in your design counts as advertising for it β€” except the logos of platforms where your own accounts are, shown next to your handle. Gambling is banned completely and without exception: casinos, slots, roulette, betting and bookmakers, lotteries, case opening and skin gambling, including "free", "social" and crypto versions. This covers names, logos, promo codes, screenshots and any references to such services. You also may not promote the following, even if it is your own project: β€” pyramid schemes, "easy money", dubious crypto and investment projects, payday loans; β€” drugs, prescription medicines, dietary supplements and "miracle cures"; β€” adult services; β€” tobacco, vapes, hookahs, alcohol; β€” weapons; β€” viewer botting, account sales, hacking.

Moderation

We do not review content in advance and are not obliged to monitor it. However, we may review content at any time and, without prior notice, hide, remove or reset a design, title or other material if it breaks these Terms or the law. The only automatic action is temporarily hiding a page design after reports from viewers β€” see "How to Report a Violation". Decisions on the measures in "Enforcement" are made by a person. We are not responsible if a violation is not found or fixed right away. Files of disputed material are kept until the review of the report is complete; the report itself and the decision are kept as described in the Privacy Policy. We comply with lawful requests from public authorities and court decisions within the required time. If material suggests a threat to someone's life or health, we may inform law enforcement.

Enforcement

Depending on how serious the violation is and whether it is repeated, we may: β€” (1) remove or hide the material, or reset the page design to the default look; β€” (2) ban changes to the page design for a period of time or permanently; β€” (3) temporarily suspend access to the Service; β€” (4) permanently delete the account and project with no possibility of recovery and ban re-registration. For severe violations we may apply measure (4) right away. Severe violations include sexual material involving minors, extremism, gambling advertising, drugs, fraud and phishing. A repeated violation of the same kind leads to a stricter measure. We notify you of the measure by email to your account address, with the reason and the rule that was broken, unless the law forbids it.

How to Report a Violation

If you see content or behavior that breaks these Terms or the law, click "Report" at the bottom of any public streamer page, use the form at bardway.com/report or write to info@bardway.com. Include a link to the page, what exactly breaks the rules and why. If two different people report a page design, it is automatically hidden from viewers until a manual review. After the review the design is either restored or the streamer faces the measures in "Enforcement". Reports are reviewed by a person. The streamer is not told who reported them unless the law or a rights holder's notice requires it. Repeated reports from the same person about the same material are not counted. Knowingly false, mass or harassing reports are themselves a violation of these Terms.

Appeals

If you disagree with a measure taken against you, reply to the notification email or write to info@bardway.com within 14 days of the notice. Include a link to your project and your arguments. A person will review the decision, and you will receive an answer within a reasonable time. Each decision can be appealed once. Automatic hiding of a design after reports is lifted after the review β€” there is no need to appeal it separately.

Indemnification

You agree to defend, indemnify and hold harmless the BardWay team, its partners and staff from any claims, damages and reasonable legal fees arising from your use or misuse of the Service.

Termination

We may suspend or terminate your access to the Service without prior notice if we have reason to believe that the use violates applicable law, harms other users, or breaches these Terms. If access is permanently terminated for a violation, the project, page design and content are deleted with no possibility of recovery. We keep only information we are required to keep by law and the data needed to enforce the re-registration ban. The paid plan period is not refunded if access is terminated or features are disabled for a violation, unless the law provides otherwise.

Warranty Disclaimer

The Service is provided "as is" and "as available". The BardWay team does not warrant uninterrupted or error-free operation or that the Service will meet your expectations, and disclaims all implied warranties to the fullest extent permitted by law.

Limitation of Liability

The total liability of the BardWay team to you for any reason is limited to the amount actually paid by you for the Service in the previous twelve months, and in any case shall not exceed the equivalent of 1,000 RUB.

Governing Law and Disputes

These Terms are governed by the laws of the Russian Federation. Any disputes arising out of or related to these Terms shall be resolved in the courts located at the registered place of business of the BardWay team. Any claim must be filed within one year after the cause of action arose; otherwise it is permanently barred.
