Purpose of the service
BardWay is a song request panel for musician broadcasters who perform their music live on stream. The service is designed for managing the streamer's own repertoire, receiving song requests from viewers, and running a queue of songs the streamer will perform themselves. BardWay does not host, stream, or distribute anyone else's sound recordings.
Streamer responsibility
By signing up and adding songs to their catalog, the streamer confirms they have the right to publicly perform each song during the stream. Full responsibility for the legality of the repertoire rests with the streamer. BardWay provides only the technical infrastructure for organizing requests and is not a rightsholder or licensee of works in other catalogs.
What may be added to the catalog
Original works of which the streamer is the author and rightsholder. Cover versions and arrangements performed under a valid live-performance licence (BMI, ASCAP, SESAC, PRS, RAO, or the equivalent collective management organization in your jurisdiction). Works that have entered the public domain under the laws of your country. Compositions licensed directly from the rightsholder.
What is prohibited
Playing back studio or other third-party recordings during the stream disguised as a live performance. Using licensed backing tracks without permission from the rightsholder. Uploading sheet music, chords, lyrics, or audio excerpts to which you do not hold the rights. Requests intended to induce the streamer to perform a work they do not have the right to perform.
Alignment with Twitch rules
BardWay operates in accordance with Twitch's Music Guidelines (https://legal.twitch.com/en/legal/music/). If you use BardWay as an extension inside Twitch, all Twitch requirements around music apply to your stream in addition to this policy. We do not audit stream content โ Twitch handles that on their side via their own detection systems.
DMCA and equivalent compliance
BardWay respects the rights of authors and rightsholders. Upon receiving a valid notice under the Digital Millennium Copyright Act (US), the EU Copyright Directive, articles 1252 and 1301 of the Civil Code of the Russian Federation, or equivalent legislation, we are obliged to review it and, within a reasonable time, take action โ up to and including removing the disputed song from the catalog and suspending or terminating the streamer's access to the service. Repeated and systematic violations lead to unconditional blocking.
Actions we take in case of violations
When we become aware of a violation โ on our own initiative, at the request of a rightsholder, of an aggregator platform (such as Twitch), or of any other interested party โ we may: (1) remove the disputed song from the streamer's catalog; (2) restrict the streamer's ability to add new songs; (3) temporarily suspend the streamer's access to the service pending investigation; (4) permanently terminate access and delete the project in case of a confirmed or repeated violation. Measures are taken proportionally to the nature and severity of the violation.
How to report a violation
If you believe that material infringing on your rights has been placed on BardWay, send a notice to info@bardway.com. Include: a description of the work and the nature of the infringement, a link to the page or project on BardWay, evidence of your ownership (registration certificate, contract, or other document), and your contact details. We commit to responding within a reasonable time and, upon confirming the infringement, taking the actions described above.
Changes to this policy
We may update this policy from time to time. Material changes are published on this page with an updated date. Continued use of the service after such changes constitutes acceptance of the revised policy.
